Welcome to AuthenticHeroes.com (“Authentic Heroes,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services, including the purchase of collectible jerseys, apparel, and digital collectibles such as NFTs (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. About Authentic Heroes
Authentic Heroes, Inc. is an e-commerce company that creates and sells collectible jerseys and other apparel items made with fiber from game-worn jerseys. These items are produced under direct license agreements with the athletes who wore them. Authentic Heroes does not license from, or represent, any professional sports leagues or teams. Our rights to use athlete names, likenesses, and related intellectual property come directly from agreements with the athletes themselves.
In addition to physical merchandise, Authentic Heroes sells digital collectibles, including NFTs, photos, and short video clips.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services or make purchases. By using our Services, you represent that you meet these eligibility requirements.
3. Purchases and Payment
All prices are listed in U.S. dollars unless otherwise stated.
Payment must be made in full at the time of purchase through the payment methods we provide.
We reserve the right to cancel any order or refuse service if we suspect fraud, unauthorized activity, or violation of these Terms.
4. Authenticity and Provenance
Authentic Heroes keeps records of each item sold, including customer information, to ensure tracking of authenticity and provenance. For certain products, such as NFTs or blockchain-recorded collectibles, purchase details may be permanently recorded on a blockchain.
5. Digital Collectibles (NFTs)
By purchasing an NFT or other digital collectible, you acknowledge that ownership is recorded via blockchain technology and cannot be altered or reversed by Authentic Heroes.
Authentic Heroes grants you a limited, non-exclusive, non-transferable license to use, display, and resell your NFT, subject to the restrictions in these Terms.
You may not use NFTs or associated content for commercial purposes (e.g., creating merchandise, advertising, or derivative works) unless expressly authorized in writing.
You acknowledge that the value of NFTs and blockchain-based assets is volatile and speculative. Authentic Heroes makes no guarantees regarding current or future value.
6. Intellectual Property
All intellectual property in the Services—including designs, logos, product images, and digital content—belongs to Authentic Heroes or its licensors (including licensed athletes). You may not copy, reproduce, distribute, or create derivative works from our intellectual property without prior written consent.
7. No League or Team Affiliation
Authentic Heroes products are licensed directly from athletes. We are not affiliated with, endorsed by, or connected in any way to professional sports leagues or teams. Any resemblance to league or team logos, trademarks, or other properties is purely incidental.
8. Shipping, Returns, and Exchanges
Shipping times are estimates only and may vary.
All sales are final unless otherwise stated. Limited returns or exchanges may be allowed for defective or incorrect items.
Customers are responsible for providing accurate shipping information. Authentic Heroes is not liable for delays or losses caused by incorrect or incomplete addresses.
9. Privacy and Data Use
We collect and store customer information for the purposes of fulfilling orders, tracking authenticity, and recording provenance. For details on how we collect, store, and protect your data, please see our Privacy Policy.
10. Limitation of Liability
To the fullest extent permitted by law:
Authentic Heroes is not liable for indirect, incidental, or consequential damages, including loss of value of collectibles or NFTs.
Our total liability for any claim relating to your use of the Services will not exceed the amount you paid for the product at issue.
11. Disclaimers
Collectibles, including NFTs, may fluctuate in value and are purchased at your own risk.
Blockchain technologies carry inherent risks, including potential hacking, technical failures, or loss of access to digital wallets. Authentic Heroes is not responsible for these risks.
Authentic Heroes makes no guarantees about investment potential, secondary market availability, or future resale value of any product.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Jersey without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Morris County, New Jersey.
13. Changes to Terms
We may update these Terms at any time by posting the revised version on our website. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
